In accessing the Mighty Minds Resource Portal it is assumed that you have read, understood and accepted the conditions of purchase and use.

Conditions

Electronic resources made available by Mighty Minds Educational Systems are licensed to the purchasing school only, not to individual staff members. As a staff member, you receive access to resources purchased by your school for activities that support the teaching and delivery of educational courses in your school only. This access will be revoked at the end of a staff member’s employment at the purchasing school. Resources are not to be retained after employment ceases and are not to be used at any other school.

Responsibilities

Mighty Minds restricts resource use to staff at the registered school and requires that users are responsible for limiting their use to non-commercial academic research or learning purposes only. It is the responsibility of individual users to ensure their use of electronic resources does not breach the terms and conditions specified in the licence agreement.

Terms of use

In order to protect the school’s data and resources it is the responsibility of the school to ensure that staff portal access is removed by the school portal administrator (or Mighty Minds as requested) when a staff member leaves the school.

It is the responsibility of the school to ensure staff with portal access follow school purchasing protocol when ordering resources from Mighty Minds. The school portal administrator (or Mighty Minds upon request) can update individual staff access to allow/disallow purchases. Staff not allowed to make purchases will still be able to access all existing school data and the resources. It is the responsibility of the school to ensure that staff with portal access follow school purchasing protocol when ordering resources from Mighty Minds via the portal. This covers all products downloaded, purchased or accessed by registered staff.

Except for personal teaching use at the registered school, content may not be downloaded, copied, reproduced, republished, modified, posted, sold, reused, translated, distributed or be retained in any form or by any means without the prior written permission of Mighty Minds Director Steven McCabe.

All portal data is stored in two data centres within Australia. No third-party organisations or organisations outside Australia have access to any data stored on the portal. This data is stored securely using best practice IT security measures.

Copyright and proprietary notices must not be removed from any printed or downloaded material and all use of material must be cited correctly.

Using resources for commercial gain is not permitted (i.e. reselling, redistributing or republishing licensed content). Transmitting, disseminating or otherwise making online content available to unauthorised users (i.e. sending to mailing lists or posting on electronic bulletin boards) is not permitted.

Posting the resource to an open class website, OneNote, or intranet etc. is not permitted.

Sending a copy of a resource to another authorised user is not permitted — every user must download their own version for use from their own portal account. However, multiple printed copies may be made from a user’s download.

Sharing login details with an unauthorised user is not permitted.

Some of the products, such as tests, contain preconditions to use, such as the payment of a licence fee or the sending of those tests to be marked by Mighty Minds. If a school wishes to reuse these products at a later time, the preconditions must be satisfied by the school each time the product is used. 

Consequences

Users found to be in breach of these terms of use will have their access to all purchased electronic resources suspended and the school’s licence will be revoked. Legal action will be taken for any infringement.

Replacement files

Mighty Minds will resupply corrupted, incomplete or incorrectly supplied resources. It is the user’s responsibility to ensure the security and integrity of files after purchase and notify Mighty Minds if a replacement file is required.

Unless otherwise stated, all content that appears on the Mighty Minds Educational Systems Pty Ltd website and portal — including text, images, audio, video, computer code and software, as well as logos and trademarks — are the copyright and sole property of Mighty Minds Educational Systems Pty Ltd. Unauthorised use is an infringement of Australian and foreign intellectual property laws.
